Jharkhand Session Court To Deliver Its Verdict Today On Dhanbad Judge Death


Latest from Jharkhand news, a session court will likely deliver its verdict on the Dhanbad judge death today, July 28, 2022, by 4 pm. Exactly one year before, Additional Session Judge Uttam Anand went for jogging when an auto-rickshaw mowed down him on an empty road in the Dhanbad district of Rajasthan. In that case, the Jharkhand police had arrested two persons- Lakhan Verma and Rahul Verma- of Digwadih in Dhanbad. Both of them were charged under Section 302 (murder), 201 (causing disappearance of evidence of offence), and 34 (common intention) of the IPC, as police suspected the incident to be a pre-meditated hit-and-run.  The incident attracted the country's top judicial officers' attention, too, as Chief Justice of India NV Ramana had spoken to the Chief Justice of Jharkhand High Court on the matter and termed the incidence as an "attack on judicial independence".  Looking after the seriousness of the crime, the Jharkhand government handed over the investigation to the Central Bureau of Investigation (CBI), which re-registered the case and filed the chargesheet in October last year. As per the chargesheet prepared by the CBI, the session court framed charges on February 2 this year. The trial in the session court lasted for 35 hearings, and the court is scheduled to deliver its judgement today, July 28, 2022. 

Prosecution's Response To Dhanbad Judge Death

To defend its clients, the defence side pleaded that the incident was not an 'intentional hit', as the crime's motive was to snatch the victim's mobile phone. Therefore, the charge of culpable homicide not amounting to murder would be attracted in this case. Responding to the defence side, the prosecution said, "Even though the motive of the crime was to snatch the victim's mobile phone, the evidence presents a completely different picture. These suggest that the incidence was a pre-meditated act that warranted a conviction under IPC Section 302".

The Story So Far

According to family members, "ASJ Anand, 50, was on a morning walk on July 28, 2021, when an auto-rickshaw knocked him down near Randheer Prasad Verma Chowk in Dhanbad. After the accident, some people saw him in a critical situation. Looking after the seriousness of the situation, they rushed him to the Dhanbad Medical College and Hospital, where he succumbed to injuries around 9 am. The autopsy reports revealed that the death of the victim occurred due to injuries caused by a hard and blunt object on the head. CCTV footage displayed that the auto-rickshaw intentionally moved towards the victim on an empty road and hit him from behind. The sudden impact from the back side injured the victim severely, due to which he succumbed to his injuries. According to sources, the victim had delivered a verdict against some land mafias in the district. Due to this, the raged party assigned Lakhan Verma and Rahul Verma to kill the victim (session judge). However, the defence side actively rejected these claims and stood strong that the murder was an accident and the intention for diverting the rickshaw's direction was to snatch the victim's mobile phone. https://twitter.com/ieexplained/status/1552455264531775488
