With SC Verdict On Validity Of PMLA, All Trials And Probes Stalled By Appeals Paced Up Again

On Wednesday, July 27, 2022, SC upheld the constitutional validity of the Prevention of Money Laundering Act (PMLA) provisions. In its orders, the apex court held that the director of ED has the same powers as vested by civil courts under the Code of Civil Procedure.  With these powers, the ED can ‘inspect and discover’; enforce the attendance of any person and examine him on oath; compel the production of records; receive evidence on records; issue commissions for the examination of witnesses and documents. In its ruling, the apex court mentioned that ED doesn't need to provide an Enforcement Case Information Report (ECIR) in every case to the concerned person, as ECIR is not an ordinary FIR.  The court added that stringent conditions for bail under the Act are legal and not arbitrary. The court delivered its verdict on a batch of petitions concerning the interpretation of certain provisions of the Prevention of Money Laundering Act (PMLA). The court ruling came at a time when the ED is regularly summoning Congress party president Sonia Gandhi to question her in the National Herald case. The ED has also filed multiple charge sheets against Karti Chidambaram and his father, P Chidambaram, in 2G spectrum allocation and the INX-Media cases. https://twitter.com/ndtvindia/status/1552218387253669888

The Union Cabinet, in its recently held meeting on Wednesday, July 27, 2022, nodded to merging Bharat Broadband Network Limited (BBNL) into the state-owned telecom operator Bharat Sanchar Nigam Limited (BSNL).  With this merger, BSNL will receive an additional 5.67 kilometres of optical fibre laid across 1.85 lakh villages in the country through the Universal Service Obligation Fund (USOF). At present, BSNL has an optical fibre cable network of over 6.83 lakh kilometres. In addition, the meeting chaired by honourable Prime Minister Narendra Modi also approved a revival package of Rs 1,64,156 crore for BSNL. Last time, BSNL received a revival package in 2019. The current revival package is a significant allocation for strengthening the state-owned BSNL’s position in this highly competitive environment. The current allocation of budget clears the way of participation of BSNL into the ongoing spectrum bidding, as BSNL will purchase a spectrum necessary for the roll-out of its 4G services in the country.  https://twitter.com/AmitShah/status/1552289473035403264
