Demolition-Drive By Prayagraj Authorities On The Residence Of Afreen Fatima


The remarks made by suspended BJP leader, Nupur Sharma resulted in stone-pelting, vandalism, and curfews across different states of the country, where people started demanding arrest of the BJP leader. The wave of protests grip several states across the nation, UP being one of them. Demanding the arrest of the suspended leaders, people from the minority community came out on roads after the Friday prayers and this lead to a massive protest in several cities of different states.  Uttar Pradesh’s Prayagraj district also witnessed people pelting stones and vandalizing vehicles over the said controversial remarks. In Prayagraj, the protest turned violent, and the mob damaged ADG’s vehicle besides pelting stones on the police personnel in Atala area of the city. Although heavy police force was deployed in the area to ensure law and order, the mob became uncontrollable.  The Chief Minister of UP ordered the UP police to stay active 24/7 in order to control the situation. However, after the violent outrage in Prayagraj, police shortlisted a few names responsible for flaming the protest, Mohammad Javed being one of them. The political activist and businessman, Mohammad Javed was claimed to be the key accused, and the authorities demolished his residence on Sunday, June 12, 2022.  The demolition happened just after a day’s notice, which was served on 11th June 2022. The Prayagraj District Magistrate Sanjay Khatri and Senior Superintendent of Police Ajay Kumar witnessed the act of demolition. 

Who Is Mohammad Javed?

Mohammad Javed is the Central Working Committee Member of the Welfare Party of India, and the district police arrested the 54-year old activist on Saturday. The police claimed that he was the prime conspirator behind Friday’s violence in Prayagraj. The focus of the authorities shifted to Mohd. Javed during the interrogation held with other accused, and the police claimed that Javed called for a “bandh”, where he asked people through WhatsApp messages to gather at a pre-decided spot.  The prime accused Mohammad Javed spoke during the investigation and told the police officers that his daughter, Afreen Fatima, suggested him to organize these protests, said by SSP Ajay Kumar. However, the police is yet to find any evidence against Afreen Fatima.

Afreen Fatima, has completed her master’s from Jawaharlal Nehru University in 2021. During her college year, she was a student leader. Furthermore, Miss Fatima is also the National Secretary of the Fraternity Movement in the student wing of the Welfare Party. 

Action Plan Of Official Authorities

Before Afreen Fatima house demolition, the Prayagraj Development Authority’s (PDA’s) gave a notice to the family on June 10, claiming that their residence was constructed against the provisions of the Uttar Pradesh Urban Planning and Development Act, 1973. The notice further added that the construction of 25x60 feet was done without the necessary permission. The police also claimed that they recovered a country made pistol, objectionable posters, and several cartridges from the house before the act of demolition. Furthermore, SSP Ajay Kumar said, “all articles are being examined and would be made part of investigation in the case”.

She further said, “We were watching the demolition on TV, as we were not allowed to go home, and the only thing the authorities could find at our home was our mark sheets and our educational books”. Responding to the claims made by authorities about serving a notice on May 10 with regard to the illegal construction, the family said that they did not receive any notice in this regard and the only notice that they were served was connected to the demolition of the house, which was pasted on their house after 10pm on Saturday.  The family’s lawyer, K. K. Roy claims to be a friend to Javed, is representing the family. He said, “Prayagraj Afreen Fatima house demolished on Sunday was an illegal act done by the authorities as the house is registered in the name of Parveen Fatima, wife of Mohammad Javed, while the notice was served to Mohammad Javed”. He backed his claim by saying that as per Muslim law, the wife’s property does not belong to the husband, and hence they will file a petition against illegal demolition.   Addressing the claim of serving notice on May 10, advocate Roy said that “no notice was given to the family regarding illegal construction. He further said that the notices were prepared in the back date overnight so that the process of demolition could be justified by the authorities”. Roy further added, “in case of illegal construction, the most authorities could do was to seal the house, after which the probe could have continued, but demolition is a draconian act that is against the rules and regulations set by the country” On the other hand, a petition was filed by a group of lawyers with Chief Justice Rajesh Bindal of the Allahabad High Court, saying that Javed Mohammad is not the owner of the land and building that was subjected to demolition, and the attempt made by the District and Police Administration and the Development Authority to demolish the building was against the basic principle of law. The petition further said that officials through UP bulldozers have done great injustice to the children and wife of Mohammad Javed.  To this, the UP Additional DG (Law and Order), Prashant Kumar told the media that the police was present at the demolition site only for law and order, while the demolition action was planned and executed solely by Prayagraj Development Authority. 

The Story So Far…

 On May 27, Nupur Sharma, the former BJP spokesperson and leader, uttered remarks against Prophet Muhammad on a TV debate show. Her comments outraged people from the countries in the Middle East, and they began condemning her statement. Furthermore, the authorities from Kuwait, Iran and Qatar summoned Indian ambassadors, while Saudi Arabia also issued strong statement. The gulf countries got furious and made the decision to Boycott Indian products.  Following the outrage due to the said controversy, top leadership of the BJP came out and took action against Nupur Sharma. For this, they suspended the basic membership of Nupur Sharma from the Bhartiya Janata Party (BJP).
